WARRANTIES

GENERAL PRODUCT WARRANTY

Every PBB product has been carefully engineered and manufactured in accordance with ANSI & BHMA specifications to be free from defects in workmanship and/or material under normal use and condition. PBB’s liability under all warranties, expressed or implied, shall be limited to replacement of defective goods only. This warranty covers PBB hinges if specified and installed on commercial or architectural type buildings for the life of the building on the mechanical functions only.

This warranty does not cover defects or damage arising from improper installation, lack of/or improper maintenance, improper storage, improper frequency or weight applications, misuse, abuse, accident, unauthorized service, or use with unauthorized non-PBB products or parts.

This warranty covers only the PBB antifriction/ball bearing type hinges in five knuckle or three knuckle configurations.

This warranty covers PBB hinges only if originally specified on the work or the product becomes accepted and approved as a substitute by the architect/owner and applied in accordance with PBB guidelines in the general specifications section of our catalog and ANSI/BHMA standard A. 156.1 grade requirements.

Model SP81, 4½” Spring Hinges are guaranteed for 1,000,000 cycles and PBB will warrant this product for five (5) years on mechanical functions only. Spring hinges for replacement guaranteed if specified, approved, applied and adjusted in accordance within PBB’s guidelines, general specifications and installation instructions.

Spring hinges are to be installed in conjunction with hinges of the same type or with ball bearing type only, failure to comply will void warranty. The above is determined according to ANSI standards and in accordance with Underwriters testing requirements for door holder closers, with or without integral smoke detectors.

PBB has retained Intertek Testing Laboratories/Warnock Hersey International and Underwriters Laboratories to test all products to the required ANSI/BHMA specifications and is under constant testing and examinations to insure that the quality of our products, continue to meet these requirements.

Based upon the results of examinations, factory testing and independent testing presented by company engineers as they relate to established and accepted engineering practices, all PBB products have been carefully engineered and manufactured under strict accordance and are judged to have passed all requirements set forth by ANSI/BHMA A156.1.2000, A156.7.1997, A156.17.1997 and A156.18.2000.

Written notice of a product or component part believed to be defective as covered by this warranty should be sent to PBB, Inc., 1311 E. Philadelphia Street, Ontario, California 91761, and should include your name and address, an identification of the product or component part, with a brief description of the defect. Upon receipt of such notice, the company will inform you where to ship such product or component part, shipping charges prepaid, for examination and, in the event such examination reveals a defect covered by this warranty, the products will be replaced.

FINISH WARRANTY

ONE YEAR FINISH WARRANTY

Subject to the limitations of liability set forth below, PBB, INC., (“Manufacturer”) hereby warrants to the original purchaser (“Purchaser”) each product (“Products”) that were purchased through a Manufacturer-authorized distributor which the Product, when applied in accordance with all Manufacturer instructions and for the purposes intended, will not chip, peel or tarnish for one year following the date of application.
This warranty excludes chips, peeling or tarnish caused by scratches or abrasions, incorrect application, misuse, abuse or deterioration of the Product due to the use of paints solvents and other chemicals.

THIS IS THE SOLE AND EXCLUSIVE WARRANTY GIVEN BY THE MANUFACTURER WITH RESPECT TO THE PRODUCTS AND IS IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE. ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, NON INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY EXCLUDED,

In the event of a failure within the applicable warranty period, Purchaser should send the Manufacturer, at the address set forth below, a written notice which identifies the Product, its application and the nature of the claimed defect. Upon receipt of such notice, Manufacturer will inform Purchaser where to ship the Product, shipping charges prepaid, for examination. In the event that such examination reveals a defect covered by this warranty, Manufacturer will either replace the Product or refund the original purchase price, as determined in Manufacturer’s sole discretion. This is the sole and exclusive liability of the Manufacturer under this warranty or otherwise.

MANUFACTURER SHALL NOT BE LIABLE FOR DAMAGES CAUSED BY DELAY IN PERFORMANCE AND IN NO EVENT, REGARDLESS OF THE FORM OF THE CLAIM OR CAUSE OF ACTION (WHETHER BASED ON CONTRACT, INFRINGEMENT, NEGLIGENCE, STRICT LIABILITY, OTHER TORT OR OTHERWISE), SHALL MANUFACTURER’S LIABILITY TO PURCHASER AND/OR ITS CUSTOMERS EXCEED THE PRICE PAID BY PURCHASER FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM OR CAUSE OF ACTION. PURCHASER AGREES THAT IN NO EVENT SHALL MANUFACTURER’S LIABILITY TO PURCHASER AND/OR ITS CUSTOMERS EXTEND TO INCLUDE INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES RESULTING FROM USE OF THE PRODUCTS OR ARISING OUT OF ANY BREACH OF THIS WARRANTY.

The term “consequential damages” shall include, but not be Iimited to, loss of anticipated profits, business interruption, Ioss of use or revenue, cost or capital or loss of damage to property or equipment. The foregoing limitations and exclusions are intended to be effective to the maximum extent permitted by law. This warranty is governed by the laws of the State of California, without regard to its conflicts of law principles. Manufacturer and Purchaser agree that the United Nations Convention on Contracts for the International Sale of Goods and the United Nations Convention on the Limitation Period in the International Sale of Goods shall not apply to sales of the Products.

PBB INC. only warrants US-1OB finish over brass or bronze base material. If steel base material is necessary, PBB then recommends US-1OA lacquer finish.
